Penalties for housing and utilities
Penalties (peni) for late payment for housing and utilities are charged under Part 14 of Article 155 of the Housing Code. There is no penalty for the first 30 days of delay. From day 31 to day 90 it is 1/300 of the refinancing rate for each day; from day 91 — 1/130.
Until 31 December 2026, the calculation uses not the current key rate but the rate of 9.5% per annum that was in effect on 27 February 2022. The Government decided this so that penalties would not rise along with the key rate.
Example. A debt of 10,000 ₽, 120 days overdue. Days 31–90: 60 × 10,000 × 0.095 / 300 = 190 ₽. Days 91–120: 30 × 10,000 × 0.095 / 130 ≈ 219.23 ₽. Total ≈ 409.23 ₽.
Penalty of 1/300 of the Central Bank rate
This formula applies to taxes for individuals and sole traders (Article 75 of the Tax Code), to child support under an agreement and in many contracts. For organisations that don’t pay tax for more than 30 days, the rate rises to 1/150 from day 31. The calculator uses a key rate of 14% — if it changed during the period of delay, enter the average or calculate each period separately.
Interest under Article 395 of the Civil Code
If a debt was not repaid on time and the contract does not set a penalty, the creditor can recover interest for the use of someone else’s money. It is calculated at the key rate for each day of delay:
Contractual penalty
If the contract sets a penalty, for example 0.1% for each day of delay, it is calculated on that basis. Choose “Under contract” and enter the percentage per day. If the contract has a cap (“no more than 10% of the amount”), enter it — the calculator won’t let the penalty exceed the limit.
The calculator does not account for partial payments or rate changes within a period. For court, it’s better to split the calculation into periods and have a lawyer check it.
