In simple terms
A penalty (пени) is a charge for being late. If you did not pay your utility bill on time, the management company or supplier charges a small percentage for each day of delay. The rules are the same for all of Russia and are set out in Part 14 of Art. 155 of the Housing Code (Жилищный кодекс).
The due date is the 10th of the following month, unless the contract sets a different date. For the first 30 days after the due date there is no penalty. This time is given so you can pay without a fine.
Formula and rate
Day 31 to day 90: debt × rate / 300 × days
From day 91: debt × rate / 130 × days
By law, the refinancing rate is used (it equals the Central Bank's key rate). But the Government has temporarily capped it: until 31 December 2026, penalties for housing and utilities use 9.5% — the key rate as of 27 February 2022. That is why penalties do not grow along with the current key rate.
Penalties are charged separately on the debt for each month, because each bill has its own due date.
Calculate it yourself

Example with numbers
The bill for March is 5,400 ₽, due 10 April. You paid on the 100th day of delay.
- Days 1–30: no penalty — 0 ₽.
- Days 31–90 (60 days): 5,400 × 9.5% / 300 × 60 = 1.71 × 60 = 102.60 ₽.
- Days 91–100 (10 days): 5,400 × 9.5% / 130 × 10 ≈ 3.946 × 10 ≈ 39.46 ₽.
Total penalties: 102.60 + 39.46 = 142.06 ₽. The amount is small, but over a year of debts on several bills it grows quickly. You can calculate your own case in the late payment penalty calculator.
How to avoid mistakes
- Check the rate. If the calculation uses 14% or 16%, the penalties are overstated: in 2026 it must be 9.5%.
- Check the first 30 days. No penalties are charged for them.
- Penalties are not charged on penalties. The base is only the debt for services itself.
- The major repairs contribution is calculated under its own part of Art. 155 (Part 14.1): the rate there is 1/300 and does not rise to 1/130.
- If the penalties are disproportionate to the debt, the court can reduce them under Art. 333 of the Civil Code. You must ask the court for this.
- Specify the purpose of payment. State which month the payment is for, otherwise the money may be applied to older debts.
If the penalties were charged incorrectly, write to the management company — a sample complaint will help. A large debt can be collected through a court order.
In Russia, Kazakhstan and Belarus
Russia
The rule is set by Part 14 of Art. 155 of the Housing Code. Until 31 December 2026, the calculation uses a rate of 9.5% (the key rate as of 27 February 2022), not the current key rate.
Belarus
In Belarus, housing and utilities must be paid by the 25th of the following month; for late payment, a penalty of 0.3% of the unpaid amount is charged for each day (Housing Code of the Republic of Belarus).
