Encumbrance: what it is

A restriction on the owner's rights recorded in the register: a mortgage, an arrest, a lease, an annuity (rent). With an encumbrance, selling or gifting the property is harder or impossible without a third party's consent.

In Russia, Kazakhstan and Belarus

Russia

Encumbrances on real estate are shown in an extract from the EGRN, the state property register — you can order one on Gosuslugi or at an MFC. After a mortgage without a mortgage note is fully repaid, the bank as a rule applies to Rosreestr itself to remove the encumbrance.

Kazakhstan

In Kazakhstan encumbrances on real estate are recorded in the legal cadastre; a certificate of registered rights and encumbrances can be obtained on eGov.

Belarus

In Belarus restrictions (encumbrances) on rights to real estate are registered by the National Cadastral Agency; the information can be obtained on request.
