What you can demand
If an item turns out to have a defect the seller did not disclose, the buyer may choose to demand (Art. 18 of the Law):
- a refund — within 10 days (Art. 22);
- a replacement with the same item — within 7 days, or 20 days if a quality check is needed (Art. 21);
- free repair of the defect — no more than 45 days (Art. 20);
- a proportionate price reduction — within 10 days (Art. 22).
For each day of delay the seller pays a penalty of 1% of the price of the item (Art. 23). In court you can also claim compensation for moral damage and a fine of 50% of the amount awarded.
Technically complex goods
Smartphones, laptops, TVs, household appliances with complex electronics and cars are on the list of technically complex goods. You can get your money back for them unconditionally within 15 days of purchase. After that — only for a significant defect, a missed repair deadline, or if the item spent more than 30 days in repair during a year of warranty.
Returning a non-faulty item
Clothing, footwear, accessories and other non-food items that simply do not suit you can be exchanged or returned within 14 days, not counting the day of purchase, provided they are in saleable condition with labels intact (Art. 25). There is a list of goods that cannot be returned this way (Government Resolution No. 2463).
The late payment penalty calculator in “Under a contract” mode at 1% per day will help you calculate the penalty for delay.
